Bombay HC Dismisses Power Contract Plea Against The Adani Group
The Bombay High Court has recently dismissed a plea against a power contract to the Adani Group. A division bench of Chief Justice DK Upadhyay and Justice Ahmed Borkar also imposed a cost of INR 50,000 on the petitioner for the vague petition. The Bombay High Court has recently dismissed a petition challenging a contract which was awarded by the Maharashtra government to the Adani Group for supplying renewable and thermal power electricity stating that the plea was unsubstantiated and reckless. A division bench of Justice Amit Borkar and Chief Justice D K Upadhyaya also imposed a cost of INR 50,000 on the petitioner Shriraj Nageshwar Aepurwar for the vague petition. Aepurwar mentioned that under Article 21 of the Constitution, the contract awarded to the Adani Group for the supply of 6,600 MW of renewable and thermal power was a violation of the petitioners’ fundamental rights to have access to a fair electric supply at a reasonable rate.
The plea also levelled allegations against the former state Chief Minister Eknath Shinde who is currently the deputy CM while the contract was awarded to the Adani Group.
The bench mentioned that the filing of such petitions containing unsubstantiated and reckless averments can sometimes even put a good cause at risk. The bench also mentioned that the petition was a scam involving various government authorities. The high court said that the petition did not contain any supporting material to show that the former Chief Minister was involved in any kind of corrupt practices.
The court also mentioned that the petitioner was not a participant in the tender process of the contract. Now this was indeed a challenging situation that the Adani Group successfully navigated. It also upheld the contract that the global conglomerate had initially signed with the Maharashtra government.
